Welcome to 7Rewards App ("the App") which is owned and operated by Entertainment Publications of Australia Pty Limited trading as Frequent Values (“Frequent Values”) and is available exclusively to registered users of 7plus (“7plus”), the video on demand service owned and operated by Seven Network (Operations) Limited (ABN 65 052 845 262) (“Seven”) .
These Membership Terms are important and create a contract between you and Frequent Values, so you should read them carefully. Your use of and access to the App and selection of offers made via this App is conditional upon your acceptance of and compliance with these Membership Terms and the terms, conditions, notices, and disclaimers contained in these Membership Terms and elsewhere on the App, and on you complying with all applicable laws of the Commonwealth of Australia (including its states and territories).
Your use of, and/or access to, the App constitutes your agreement to these Membership Terms. Frequent Values reserves the right to amend the Membership Terms at any time. Any changes will be published in these Membership Terms. Since you are bound by these Membership Terms, you should periodically revisit them to monitor changes.
7Rewards is a pilot program exclusive to invited registered users of 7plus only. To become a 7Rewards member and use the App you:
Whilst Frequent Values provides you with offers via the App as part of your 7Rewards membership, you acknowledge and agree that redemption of such offers is done by you in connection with a separate transaction between you and the relevant merchant (such as restaurant or food outlet), at the point of sale (such as at the restaurant) (“Merchant Transaction”).
If you have any questions relating to your use of the App, general enquires about your membership, or queries with respect to your redemption of an offer made to you on the App, you can contact Frequent Values via e-mail at 7Rewards@frequentvalues.com.au. If you have any questions relating to your Merchant Transaction itself (for example in relation to a booking you would like to make with a restaurant, or the quality of the meal served to you by a restaurant), you should contact the merchant directly.
When you use the App, you acknowledge and agree that you may be invited by Frequent Values to participate in feedback surveys, online surveys and/ or focus groups.
Frequent Values is collecting your personal information for the purpose of establishing and administering your 7Rewards membership and access to the App (along with any future service we provide, and which requires logging in) (where applicable) and sending you 7Rewards offers. Frequent Values will otherwise handle your personal information in accordance with Frequent Value’s Privacy Policy which is available at

In addition, by becoming a 7Rewards member and/ or using the App, you consent to Frequent Values using your personal information for the purpose of Frequent Values sending you 7Rewards special offers, restaurant updates, discounts, invitations to enter competitions, and new products and services related to your membership (via e-mail, SMS and other on and off-line communications). If you do not wish to receive these communications from us, please notify Frequent Values by e-mail at 7Rewards@frequentvalues.com.au. You also consent to Frequent Values and its related entities sending you information regarding programs, products, and services available through them and/ or through their business partners. We will always provide you with the ability to opt out of those communications.
You also agree that we may use proprietary measurement software in the App which will allow users to contribute to market research or audience ratings services.
You also consent to Frequent Values sharing your personal information with Seven including any personal information that you do not otherwise provide to Seven as part of your 7Plus registration such as your mobile phone number and to enable Seven to better understand its audiences.

All information, text, material, graphics, software and advertisements on the App ("Content") are protected by Australian and international copyright and trademark laws.
Apart from any use permitted under the Copyright Act 1968 (Cth) you must not modify, copy, reproduce, republish, frame, upload to a third party, post, transmit or distribute this Content in any way except as expressly provided for on the App or expressly authorised in writing by Frequent Values.
The reproduction, duplication, distribution (including by way of email, facsimile or other electronic means), publication, modification, copying or transmission of material from the App is STRICTLY PROHIBITED unless you have obtained the prior written consent of Frequent Values or unless it is specifically stated otherwise within the App. The material covered by this prohibition includes, without limitation, any text, graphics, logos, photographs, audio, or video material or stills from audiovisual material available on the App.
This means you are strictly prohibited from creating works or materials that derive from or are based on the materials contained in the App including, without limitation, fonts, icons, link buttons, wallpaper, desktop themes, on-line postcards and greeting cards and unlicensed merchandise. This prohibition applies regardless of whether the derivative materials are sold, bartered, or given away.
The App may also include materials owned by third parties and posted on the App by virtue of a licence, grant, or some other form of agreement between the third party and Frequent Values.
The App contains links to other websites outside the App for your information and convenience. Frequent Values makes no warranty or representation as to the functionality of these links, the security of those sites or the reliability or accuracy of the information contained on these sites. You access any such website entirely at your own risk and your purchase from any third party is entirely at your own risk.
Strictly on the condition that you keep all Content intact and in the same form as presented on the App (including without limitation all copyright, trademark and other proprietary notices and all advertisements), you may ONLY download and/or view the Content for your personal, non-commercial use.
Frequent Values and its employees and agents will not be liable to you or any other person for any loss, injury or damage arising from or as a consequence of any act or omission by Frequent Values.
Under Schedule 2 of the Consumer and Competition Act 2010 (Cth) (“Australian Consumer Law”) and other state based legislation, certain warranties and conditions (“Implied Terms”) are implied into your contract with us in relation to our provision of 7Rewards offers to you. The operation of, and liability for breach of, the Implied Terms cannot be, and are not in these Membership Terms, excluded and can only be limited in certain circumstances. Except for the Implied Terms, we exclude to the fullest extent permitted by law all terms implied by statute, at law, in fact or otherwise.
You understand and agree that Frequent Values have no warranty obligations or other liabilities to you under these Membership Terms.
Frequent Values excludes to the fullest extent permitted by law all liability for any liabilities, losses, damages, costs or expenses (whether arising in contract, tort (including negligence) or under any other cause of action) suffered or incurred by any person in connection with these Membership Terms or an act or omission of our or any of Frequent Values’ personnel (as applicable) in connection with these Membership Terms:

While Frequent Values does its best to ensure the optimal performance of the App, you agree that you use the App and rely on material contained in the App at your own risk.
Subject to the Implied Terms:
Nothing in these Terms shall limit or exclude Frequent Values’ liability for death or personal injury caused by our or their negligence.
To the extent permissible by law, Frequent Values will not be liable under these Membership Terms for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise.
To the extent permissible by law, Frequent Values’ maximum aggregate liability under these Membership Terms whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the product(s) in question.
We may transfer all or part of our rights and obligations under these Membership Terms to our business partners or related bodies corporate including Seven Network (Operations) Limited. However, if assignment is likely to have a detrimental impact on you, and that impact is more than a minor impact, we will notify you about this.
You acknowledge that the offers made to you via the App are provided for your personal, non-commercial use, and may not be resold, in whole or in part.
You agree to indemnify and hold Frequent Values harmless from and against any and all claims, proceedings, injuries, liabilities, losses, costs, and expenses (including reasonable attorneys’ charges on an indemnity basis), including but not limited to claims against Frequent Values:
These Membership Terms are governed by the laws in force in New South Wales, Australia and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia and any courts which may hear appeals form those courts.
The Membership Terms are effective until terminated by Frequent Values. Frequent Values may terminate these Membership Terms, your membership and/ or your access to the App at any time without notice, including but not limited to, for breach of these Membership Terms. In the event of termination, you are no longer authorised to access the App, but all restrictions imposed on you, licenses and waivers granted by you and all Frequent Values’ disclaimers and limitations of liability set out in these Membership Terms (as amended) will survive.
